User Behaviour and Protection of Minors

Any content accessible to the public by the User of the service is the responsibility of the user. This responsibility primarily relates to photos and other media accessible to the public and photos and other media shared with others via Album, Cloud and Mail services, large files stored and sent through the Send service, and articles posted online by the Tips service.

For example, the User is prohibited from posting Content relating to acts that condone crimes against humanity, incitement to violence, racial hatred or child pornography. In addition, any public album featuring sensitive photos (such as photos of children) can be automatically switched to a private album or shared. An email will then be sent to the member to inform him of this action, and he will then be free to switch this album again in public if he wishes, with full knowledge of the facts.

Zaclys allows to pool resources and make them accessible to as many people as possible by free, donations or contributions. Zaclys also pursues ethical objectives such as respect for privacy, sharing and support for educational structures. The User is aware that these advantages are the result of a small structure operating and that he cannot, on the other hand, require the level of services and guarantees of a large company.

 

Intellectual property

Zaclys respects intellectual property rights and we ask you to respect them as well. Users who post Content online on Zaclys' various services must have all the rights.

Unless otherwise stated, any article or content posted online in a public manner is by no means free of rights.

The User is prohibited from engaging in a violation of intellectual property rights (including music, video, animation, games, software, databases, images, sounds and texts) or any other property rights.

 

Your freedoms

Zaclys is managed by a SARL. The site is hosted on French servers (at OVH in Roubaix), developed and maintained on French territory (Franche-county) and uses exclusively free software (linux).

Respect for your freedom and rights is a top priority for us.

Unlike other well-known sites, we guarantee your freedoms and intellectual property rights: Zaclys does not grant any rights to use, reproduce, modify, create derivative works, communicate, publish, represent, display, distribution… your content.  Your content remains your content and by no means ours.

It is for all these reasons that Zaclys is a real alternative in the face of the hegemony of the internet giants.

 

Your obligations

Unless otherwise stated, the services offered are exclusively reserved for use in a family setting.
Any intensive and/or abusive use of a service can result in suspension and power outage.

For use in a professional setting we offer dedicated servers (see cloud page in particular) that are suitable for your use.

In any case, none of our services can be used outside the legal framework, nor outside the ethical framework, including none of our services can be used for advertising canvassing or deceit, or for any business activity that contradicts our principles and values.

In order to apply these good rules of practice, we reserve the right to use various tools to protect our services and to put in place any technical solution to achieve this. This is in keeping with your privacy.

 

Prejudice

Mother Zaclys cannot in any way be held responsible for any injury or injury, obligation or expense which would be alleged to be a result of the use of the Site, including, without any limitation, any fault, error or omission or interruption of service or any delay that may have occurred. The User exploits the Site at its own risk. Zaclys cannot, in particular in the event of negligence or technical incident, be held liable for direct, indirect, incidental, individual or secondary damage, even if it has been warned that the damage is likely to occur.
The User states that he knows and agrees that Zaclys is not responsible for the conduct of any of the Users, and he agrees.

Using the Site, the User agrees to hold Zaclys to cover up any lawsuit or claim for compensation, any injury or injury, any financial obligation or expense (including, calculated at a reasonable rate, legal fees) that could result for Zaclys from its use of the Site, including, but not exclusively, any claim on the basis of facts that, if proven , would constitute a violation of the User's interest in these Terms of Use. The only solution available to a User dissatisfied with all or part of the Site Content or these Terms of Use is to stop using the Services.

 

Account inactivity 

Services are subject to inactivity rules, which are designed to optimize the terms of use of the Services by the largest number of users.

Any account that has been unused for 365 consecutive days could lead us to contact the member. If the account is small, nothing happens. If it is cumbersome and the member no longer connects to it, a manual raise is performed. After a delay of several weeks after this relaunch, it is possible that the account will be archived. Nothing will be lost but the member will have to contact us to reactivate it.

 

Service guarantees

The Services, free for so-called "basic" services, are designed to meet the unfe professional, reasonable and normal use of the largest number of Users. As a result, Zaclys provides no assurance as to the ability of the Services to meet the requirements, including the accuracy, accuracy, reliability and speed of a service for business use or a service for the storage of valuable data.

Due to the evolving nature of the Services, the constraints of maintenance and technological evolution, the continuity of the Services is not 100% assured. In the event of a service disruption, Zaclys will use all reasonable means to remedy it as soon as possible. 

 

Subscribe and subscribe users to "Zaclys" services

The services are accessible by subscription of an annual subscription. Subscription rates are described on the subscribe and subscribe page. These rates can be changed without notice (on average 1x every 7 years).

 

Backups

As indicated when opening an account, and as described on the table showing subscriber benefits, only subscribers receive backup copies of their files posted online. The non-subscriber user, knowingly, is therefore not affected by the backup system as mentioned on the subscription page, and accepts the risks. Ditto for the encrypted cloud.

 

End of subscription

The subscriber automatically receives an alert email before the end of the annual subscription. If the member does not renew his subscription, nothing is deleted, he just loses the additional functions related to his account, but keeps all of his documents.

 

Using the "Cloud Dedicated" service

Any user of a Dedicated Cloud server must comply with the terms of use of the "ownCloud Server" AGPLv3 license or those of Nextcloud, depending on the option chosen.

In particular, the user of a Dedicated Cloud server cannot engage in direct business activity with it, such as subletting a cloud server, hosting cloud user accounts for commercial purposes, selling services or products via this service…

 

Technology and security

Particular attention is paid to data privacy and security.
At Zaclys, each display of photos and even album covers is conditioned by an access control: that is, our server only agrees to display a photo or a cover after checking whether the user has a right of access (either he has identified/connected on the site and he is the author of the album, either he has been invited to consult it and has a unique and confidential key in the link he can use to visit this album). The same goes for large file transfers used on the Send service and files shared via the cloud service.

Changing services and terms of use

As the services offer is scalable, Zaclys will be required to launch new services, but also if necessary, to remove some of them or to modify the characteristics of existing services. Zaclys will also be able to change these Terms of Use.
